The detention of a criminal defendant before trial. Pretrial detention is the maintenance of a criminal defendant in detention prior to trial on one or more of several independent grounds: the defendant has been denied bail because the court found the defendant posed a danger to others or a risk of flight; the defendant could not afford bail; or bail was granted but revoked.
